Users are responsible for maintaining account security and all activities under their account. Please report any unauthorized access or security concerns promptly.

FairPlay Evaluation Process

Games on our platform undergo independent FairPlay evaluation to assess monetization practices, progression systems, and content accessibility. This evaluation is conducted by qualified third-party assessors.

FairPlay evaluations reflect the game state at the time of assessment. Games may be updated by developers, and we encourage community feedback to help maintain current information about platform titles.

Game Downloads and Usage Rights

Games available through our platform are provided by their respective developers and publishers. Your right to download and play these games is subject to their individual license agreements and our platform terms.

We provide download links and launcher functionality but do not own the games themselves. Any issues with game content, performance, or licensing should be directed to the appropriate game developer or publisher.

Pro Subscription Services

Our Pro subscription offers enhanced features including library synchronization, cloud save backups, and ad-free browsing. Pro features are billed monthly or annually and can be cancelled at any time without affecting your access to free games.

Pro subscription benefits apply only to platform features and do not unlock additional game content or provide advantages within games themselves, maintaining our commitment to fair play standards.

Community Guidelines and Conduct

Users must maintain respectful behavior in all community interactions, including reviews, forums, and reporting systems. Harassment, spam, false reporting, or attempts to manipulate certification processes are prohibited.

We reserve the right to moderate content, suspend accounts, or remove users who violate community guidelines. Repeated violations may result in permanent platform access restrictions.

Content Submission and Reviews

User-generated content, including game reviews and community posts, must be original, honest, and relevant. You retain ownership of your content but grant us a license to display and distribute it through our platform.

We may remove content that violates our guidelines, infringes on intellectual property rights, or contains false information. Users are encouraged to report inappropriate content through our community reporting system.

Intellectual Property Rights

The OpenPlay Arcade platform, including our logo, branding, and proprietary technology, is protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works without explicit permission.

Game content, trademarks, and copyrights belong to their respective owners. Our platform serves as a distribution channel and does not claim ownership of third-party game content or intellectual property.

Platform Availability and Modifications

We strive to maintain consistent platform availability but cannot guarantee uninterrupted service. Scheduled maintenance, technical issues, or security concerns may temporarily affect platform access.

We reserve the right to modify, update, or discontinue platform features with reasonable notice. Major changes affecting user experience will be communicated through email or platform announcements.

Limitation of Liability

OpenPlay Arcade provides the platform "as is" without warranties of any kind. We are not liable for game content, performance issues, data loss, or indirect damages arising from platform use.

Our liability is limited to the amount paid for Pro subscription services in the preceding 12 months. This limitation applies to the fullest extent permitted by applicable law.

Dispute Resolution and Governing Law

These terms are governed by Brazilian law, and disputes will be resolved through binding arbitration in São Paulo, Brazil. Users agree to attempt good-faith resolution before pursuing formal legal action.

For minor disputes under applicable small claims court limits, users may pursue resolution in their local jurisdiction. Class action lawsuits and jury trials are waived to the extent permitted by law.

Account Termination and Data Retention

Users may terminate their accounts at any time through account settings. Upon termination, we will delete personal information according to our privacy policy while retaining necessary data for legal compliance.

We may terminate accounts for terms violations, fraudulent activity, or extended inactivity with appropriate notice. Terminated users may appeal decisions through our support channels.

Updates to Terms of Service

We may update these terms periodically to reflect platform changes, legal requirements, or policy improvements. Significant changes will be communicated with at least 30 days' notice before taking effect.

Continued platform use after terms updates constitutes acceptance of the revised agreement. Users who disagree with updated terms may terminate their accounts before the changes take effect.
